The most common injuries at work are slips, trips and falls. Most of us take for granted that accidents ultimately do happen and blame cannot be attributed to the employer. However in cases where you are injured while at work and the cause of the injury was under the control of your employer, you may have a claim against them for negligence.

Broken bones, bruising and general pain which prevents you from enjoying your usual daily activities and lifestyle are all considered as personal injury. There are some important things to remember if you are involved in an accident at work.

  1. Male sure the incident is reported to a manager or first aider. Your employer has a duty to have a reporting system in place for accidents in the work place. If you work in the field, make sure the accident is reported to an appropriate manager as soon after the accident as possible
  2. Gather as much information as possible about the accident and make clear notes. Record the date, time, and location of the accident and the names of any witnesses. Is there CCTV of the accident, did you need to go for medical treatment following the accident? Which hospital did you attend? All of this information will become useful when assessing your claim.
  3. Consult with a solicitor who specialises in Personal Injury claims. You are more likely to be successful in making a claim for compensation if you are represented. Solicitors know the rules surrounding accidents at work and the process involved in making the claim.
  4. Act fast. In most cases you have 3 years from the date of the accident to bring a claim at court for personal injury. The sooner you consult legal advice the more time the solicitor will have to prepare your claim.
