A boundary can often become an issue for neighbours who are unaware where the boundary line falls and who is responsible for the maintenance or repair of the boundary.
The Land Registry in drafting the title plan use Ordnance survey mapping and as such they show general boundaries of the property. A deed plan or the deed itself may hold information regarding the measurements of the boundary and it is important to review these documents if you are unsure where the boundary of your property falls.
It is common for owners of a property to not be familiar with which of their boundaries, if any, they have a legal responsibility for. There are no hard and fast rules over which particular boundaries of a property are the responsibility of the owners. It all depends on the deeds or the markings on a deed plan. Some deed plans have a “T” mark on a particular boundary and include wording that highlights the responsibility to maintain that boundary. Again, it is important to review any deeds or plans you hold for your property to locate any such information to assist you if you are unaware of who is responsible for a specific boundary.
It is also wise to ensure you are familiar with the boundaries of any property you are purchasing and your potential responsibility for the same to make sure that this is the right property for you.
