Divorce and Pensions – are you entitled to a share?

When advising clients about matrimonial assets within divorce proceedings, they often don’t realise Pensions form part of those assets.

It can be the case that one person may have a modest pension, or even no pension at all, compared to their former spouse, especially when one person has given up their career or had gaps in their career to raise children.

In those circumstances it should be possible to obtain a share of the former spouses pension or potentially offset the value against other assets to address any inequality.
