Urgent Request from the Law Society for the New UK Prime Minister

The Law Society has several high-priority requests for the new incoming PM, for both the civil and criminal justice systems, particularly in relation to legal aid:

Civil Justice

  • Reinstate legal aid for early advice from lawyers specialising in family and housing law
  • Review legal aid “means test” criteria
  • Scrap plans to introduce a hike in probate fees, which would amount to a ‘stealth tax’
  • Reconsider plans to reform personal injury legislation in the Civil Liability Act and abandon plan to increase the small claims limit

Criminal justice

  • Make urgent changes to criminal legal aid fees to ensure the sustainability of the criminal justice system which is likely to require a review of its long-term viability
  • Modernisation of court system and technology in a way which widens and enhances access to justice for all

Brexit

  • Negotiate mutual access UK lawyers as well as EU lawyers to practise and seek to secure rights of audience in EU courts and legal professional privilege at EU level for clients
  • Avoid a ‘no deal’ Brexit at all costs
